How a decedent-estate transaction flows through five attorney phases — the blockers that can kill it, the waits that stretch it, and the moves that resolve it. Grounded in 25 real dossiers. Tier 1 / Full Monte.

Two-axis read-through (carry it through every phase): PRICE friction = Condition (caps value, rarely kills). CLOSEABILITY friction = authority instrument + liens + clock (decides IF it closes). The deals that DIED died on closeability — triage that first.
PRE-EA1 — Triage Gate 🔒 FULL-MONTE Before any EA work, confirm this is actually a decedent estate and name the authority instrument — the instrument, not the trigger, sets the friction.
Hurdles
  • Mis-tagged “estate” that is actually a LIVING owner → wrong process lane (4/25 mis-tagged: 1666-beaconshire living-owner POA, 6111-craigway living co-owners, 23214-diamond-knoll living short-sale, 1829-bering-24 living short-sale).
  • Surname/CRM “estate” flag is a heuristic, not evidence — acting on the label alone mis-routes ~16% of deals.
Delays
  • Discovering mid-process that the instrument is dependent (court) not independent → re-scopes the whole timeline.
Solutions
  • 🔒 FULL-MONTE Run two checks in order: (1) owner living or deceased? — verify from deed / death certificate / owner contact, NOT the surname flag; (2) classify the AUTHORITY INSTRUMENT (indep / dependent probate · AoH · POA · guardianship · life estate · trust · servicer-HUD). EA1 Intake / Assessment Attorney determines viability — equity, mortgage owed, heir identification, foreclosure prevention, independent-vs-dependent determination.
Hurdles
  • Foreclosure-exposed at intake — the clock is already running before authority exists (12002-hawkins $8,308 arrears + foreclosure-exposed; 1235-oxbow-crossing active foreclosure on the Nov docket; 478-el-toro pre-foreclosure scare; 3920-w-alabama trustee sale dated 8/06).
  • Negative/thin equity or unknown payoff — viability unclear until mortgage, reverse mortgage, and arrears are summed (7110-pine-bower reverse-mortgage payoff; 15902-elmerald-briar ~$140K payoff).
  • Wrong administration type assumed — a “simple death” turns out contested/no-will → dependent admin (12002-hawkins heirship route FAILED → escalated to dependent probate File 24-807459-EH).
Delays
  • Death-certificate / payoff-letter waits — mortgage payoff needs death cert + SSN before the servicer will quote (4427-sanford-77035).
  • Out-of-state / distracted executor slows the first data pull (15902-elmerald-briar NJ executor mid car-title saga; 406-sue VA executor caregiving a sick mother).
  • Upfront legal/probate carry must be sourced before filing (~$13K legal carry, 223-sparkling-water).
Solutions
  • Open title EARLY — seller is NOT the original purchaser, so surface liens/heirship now, not at contract (universal early move).
  • 🔒 FULL-MONTE Capture foreclosure/default STATUS at intake as a first-class field — it sets the closeability clock and triggers the payoff-race playbook (1829-bering, 23214-diamond-knoll).
  • Equity/viability worksheet: payoff (incl. reverse-mortgage HECM) + arrears + back taxes + est. as-is value → go/no-go before the family invests emotionally.
  • 🔒 FULL-MONTE For foreclosure overlay, escalate the servicer/attorney to “Urgent” payoff and pursue a sale-pending postponement (223-sparkling-water “Urgent” payoff escalation; 1829-bering foreclosure postponed 1 wk).
EA2 Legal Authority / Probate Establish who can legally sign. Probate the will (if any), appoint the executor. Independent = fully probated will, executor signs. Dependent = no will/contested, court for every step.
Hurdles
  • No will / contested → dependent administration = court controls every step (135-woodvale dependent: court Decree/Order + bond; 5347-friar-tuck dependent: Decree Confirming Sale required; 12002-hawkins escalated to dependent).
  • POA defects — wrong/defective legal description or durability question (11410-lakeside-place POA legal-description defect cured; 1666-beaconshire POA must be confirmed NOT-revoked at close).
  • Living-incapacitated owner needs guardianship — no decedent, so probate doesn’t apply; court must appoint a guardian (7110-pine-bower Letters of Guardianship + court sale approval; no DOD → no step-up basis).
  • 2-year probate window blown → title standoff (4132-deerfield-village probate not completed within 2-yr window).
Delays
  • Court appointment lead time — Letters Testamentary / Administration / Guardianship is the title-GATING doc; nothing moves until it’s in hand (1926-wakefield Letter of Testamentary gates title; 8815-lawncliff authority clean only once Letters in hand; 7110-pine-bower Letters furnished 6/29 at prep stage).
  • Dependent-admin court calendar — judge controls the date, not us (5347-friar-tuck decree unsigned at last email — timing, not approval).
Solutions

EA3 Heirship Resolution All heirs identified + located, agreements obtained, signing authority confirmed, disputes resolved (no majority rules — ALL must sign). Data gathering complete for both legal + RE sides.
Hurdles
  • Contesting / fractional heirs — all must agree, no majority rules (3907-faulkner 25/25/25/25 fractional heirs, initially contesting sisters).
  • Heirship-affidavit route can FAIL and force escalation to probate (12002-hawkins AoH route failed → dependent probate).
  • Minor + incapacitated heirs — need court Application to Sell + an absent parent’s consent + handle an incapacitated heir with no guardianship (223-sparkling-water minor heirs via Gonzalo Mondragon consent; Deborah Mapes Alzheimer’s, no guardianship — title workaround/POA).
  • AoH execution failures — name-vs-ID mismatch, divorced/maiden name, missing 2 non-family witnesses (9630-bundy-ln 2 witnesses Vance/Topping; 4427-sanford Millspaugh vs divorced “Simms”; 12002-hawkins LaCheita name mismatch).
Delays
  • Scattered / remote / unreachable heirs — locating and coordinating signatures across geographies (7207-palmito 5 heirs scattered Japan + FL prison).
  • Incarcerated heir — physical POA via prison legal-mail; digital is invalid; correct SPN/inmate ID needed → stalls months (7207-palmito POA received 11/03, File 23-00922).
  • Multi-decedent / multi-generation chains stretch the data-gathering (7207-palmito Phyllis predeceased + Hugh; 223-sparkling-water ~7 deceased / 7 living heirs).
Solutions

  • Title encumbrance zoo surfacing late (open title early): mechanics lien from a scam contractor (12002-hawkins mechanics lien + 2 deeds of trust — the canonical closeability death, NEVER closed); HOA liens (11626-village-place-326, 1829-bering, 3920-w-alabama, 8815-lawncliff); back property taxes (3907-faulkner ~$11K); IRS/income-tax (7518-golden-thistle); common-name false-positive liens needing DOB+SSN-last-4 (3920-w-alabama Baker false-positives); FIRPTA on a foreign heir (7207-palmito).
  • Underwriter rejection on unfinished/2-yr probate even when escrow is ready (4132-deerfield, 3907-faulkner).
Delays
  • MERP (Medicaid Estate Recovery) clearance — a distinct order, weeks, uncontrollable, long-lead (25626-glen-loch MERP P0 + dual-estate no-tax letters paced the close).
  • Dependent-admin court windows — Report-of-Sale 10-day window + Decree Confirming Sale judge timing (135-woodvale decree attached to deed as Exhibit A; 5347-friar-tuck).
  • POA underwriter rejection cycle — missing/duplicate pages bounce and must be re-executed (3907-faulkner POA rejection cycle).
Solutions
  • 🔒 FULL-MONTE SIGNATURE MOVE — use a title company with MULTIPLE TITLE PLANTS: when a title problem becomes an issue they can farm it out to a different insurer, saving a deal another company would kill. (Internal only — never shared.)
